הערב דיווחנו - במהלך דיון של הקבינט המצומצם לפני כניסת הצום, ביקש בן גביר שהממשלה תודיע שהיא מפעילה את עונש מוות למחבלים על המחבל שביצע את הפיגוע בערב יום הכיפורים שבו נרצח נתנאל שקרון. מדובר במחבל הראשון מיהודה ושומרון שנתפס בחיים מאז העברת החוק בסוף חודש מרץ. יש לציין שאחרי העברת החוק הוגש בג״צ בנושא (עתירה של ח״כ גלעד קריב ומכון זולת) והסוגיה עדיין תלויה ועומדת.

שעתיים לפני יום כיפור: בן גביר העלה בדיון המצומצם את הפעלת עונש המוות למחבלים שעתיים לפני כניסת יום כיפור התקיים דיון מצומצם שעסק במצב הביטחוני ביהודה ושומרון. במהלך הדיון העלה השר לביטחון לאומי איתמר בן גביר את סוגיית עונש המוות למחבלים, וטען כי המקרה הנוכחי הוא המקרה הראשון שעומד בקריטריונים להפעלת החוק. ראש הממשלה בנימין נתניהו הביע עניין בנושא וביקש לקבל תשובות מגורמי צה״ל באשר לאפשרות ליישם את החוק במקרה הנוכחי. הפצ״ר לא השתתף בשיחה. נציגי צה״ל שהשתתפו בדיון מסרו כי מבחינתם אין מניעה. בעקבות הדברים הוחלט כי הקבינט המצומצם יקיים ישיבה מקצועית נוספת בנושא, בהשתתפות הפצ״ר, לצורך בחינת המשך הטיפול והיישום.
