לאחר דחיית העתירה נגד לשכת עורכי הדין: נטוביץ ובן־ארי יערערו לעליון עו"ד יצחק נטוביץ וערן בן־ארי הודיעו כי יערערו לבית המשפט העליון על דחיית עתירתם נגד לשכת עורכי הדין ויו"ר הלשכה עמית בכר. בעתירה ביקשו השניים לקבוע כי הלשכה אינה מוסמכת להשתמש בכספי החובה שהיא גובה מעורכי הדין לצורך פעילות פוליטית — ובה בין היתר פרסומים נגד שרי ממשלה, מימון או השתתפות בהפגנות ופעילות נגד החלטות הכנסת. לטענתם, בית המשפט דחה את העתירה בעיקר מטעמי סף ודיון, ובהם שיהוי, מבלי להכריע בשאלה העקרונית: האם גוף סטטוטורי רשאי לעשות שימוש בכספי חובה של חבריו למטרות פוליטיות. "התוצאה שבה שאלת גבולות סמכותה של הלשכה לעשות שימוש בכספי חובה לצרכים פוליטיים אינה מתבררת לגופה — היא תוצאה קשה שאיננו יכולים להשלים עמה", מסרו. השניים הודיעו כי יגישו ערעור לעליון וימשיכו לפעול, לדבריהם, "לשחרור ציבור עורכי הדין מכפייה של גוף סטטוטורי שאיבד את אופיו המקצועי והפך לגוף פוליטי".

According to them, the court rejected the petition mainly on threshold and procedural grounds, including delay, without ruling on the fundamental question: whether a statutory body may use its members' mandatory fees for political purposes. "An outcome in which the question of the limits of the Bar Association's authority to use mandatory fees for political purposes is not examined on its merits is a harsh outcome that we cannot accept," they said. The two announced that they will file an appeal to the Supreme Court and will continue to work, in their words, "to free the public of lawyers from the coercion of a statutory body that has lost its professional character and become a political body."
